4/21/2009 FTC Press Release:

The Federal Trade Commission will hold a day-long public workshop on June 1, 2009 in Washington, DC, to explore proposed changes to the FTC’s Business Opportunity Rule. The workshop, which is free and open to the public, will examine possible changes to the rule that were outlined in a Revised Notice of Proposed Rulemaking (RNPR) on March 26, 2008.

The workshop will primarily explore issues relating to the effectiveness of a proposed one-page Business Opportunities Disclosure Form that sellers of business opportunities would be required to provide to prospective purchasers. The proposed Disclosure Form is intended to provide prospective purchasers with information they can use to make an informed decision about the potential business opportunity, including information about earnings claims, legal actions, existence of cancellation or refund policies, and references. The workshop also will address general issues raised in comments that have been submitted to the FTC in response to the proposed rulemaking. A more detailed agenda will be published at a later date, before the scheduled workshop.

Business opportunity ventures include vending machine routes, rack display operations, and medical billing ventures. The FTC’s new proposed rule is aimed at protecting consumers from bogus business opportunities while minimizing compliance costs for legitimate businesses.

The workshop will be held from 9 a.m. to 5 p.m. at the FTC’s satellite building conference center, located at 601 New Jersey Avenue, N.W., Washington, DC. All attendees will be required to display a current driver’s license or other form of photo identification for entry.

The Commission will be accepting comments on the topics to be covered at the workshop until June 15, 2009. The FTC staff also invites interested parties to submit requests to be panelists by May 4, 2009. Interested parties should include a statement detailing their expertise on the issues to be addressed at the workshop and their complete contact information. Requests to participate filed in an electronic form should be sent to: businessopportunityworkshop@ftc.gov.

Reasonable accommodations for people with disabilities are available upon request. Requests for such accommodations should be submitted via e-mail to: cmcglothin@ftc.gov or by calling Carrie McGlothin at 202-326-3388. Such requests should include a detailed description of the accommodations needed and a way to contact you if we need more information. Please provide advance notice.

The Commission vote approving publication of the Federal Register Notice announcing the workshop was 4-0.

The Federal Trade Commission works for consumers to prevent fraudulent, deceptive, and unfair business practices and to provide information to help spot, stop, and avoid them. To file a complaint in English or Spanish, visit the FTC’s online Complaint Assistant or call 1-877-FTC-HELP (1-877-382-4357). The FTC enters complaints into Consumer Sentinel, a secure, online database available to more than 1,500 civil and criminal law enforcement agencies in the U.S. and abroad. The FTC’s Web site provides free information on a variety of consumer topics.

The Federal Trade Commission today announced the fourth in a series of public hearings exploring the evolving market for intellectual property. These hearings, to be held April 17, 2009, in Washington, DC, will explore how corporations, inventors, and patent intermediaries value and monetize patents, strategies for buying and selling patents, and the role of secondary markets for intellectual property.

Some of the most significant recent changes in markets for intellectual property have occurred through the emergence of new business models involving the buying, selling and licensing of patents. The April 17 hearing also will showcase some of the recent academic scholarship about the development and functioning of markets for intellectual property and the policy implications surrounding them. James E. Malackowski, President and CEO of Ocean Tomo, will deliver the keynote address. An agenda for the hearings is available on the Web site for the hearings and as a link to this press release.

These hearings are part of an ongoing series of public hearings examining changes in patent law, patent-related business models, and new learning about the operation of the IP marketplace since the October 2003 Commission report on the patent system, “To Promote Innovation: The Proper Balance of Competition and Patent Law and Policy.” The Commission held the initial hearing in the series on December 5, 2008, and held hearings on remedies February 11 and 12, 2009. The Commission is holding hearings on March 18-19, 2009, covering the operation of patent markets, with an emphasis on the notice functions of patents. The Commission will hold its last hearing in the series on May 4-5, 2009, in Berkeley, California, in cooperation with the Berkeley Center for Law and Technology.

The Commission is seeking public comments on all issues to be discussed throughout the entire series of these hearings, and in response to any of the topics raised in the Federal Register notice announcing the hearings on the Evolving IP Marketplace. Comments must be received by May 15, 2009, and should refer to “Evolving IP Marketplace – P093900.” The Federal Register notice and information on how to submit written and electronic comments to the Commission are available at the Web site for the hearings, http://www.ftc.gov/bc/workshops/ipmarketplace.

The FTC’s hearings on the Evolving IP Marketplace are free and open to the public. Pre-registration is helpful but not required. All attendees must present a valid photo ID for admission to the agency’s Satellite building, which is located at 601 New Jersey Ave., NW. The hearings will be accessible to people with disabilities. Anyone needing a related accommodation should contact Carrie McGlothlin at the FTC at 202-326-3388 or cmcglothlin@ftc.gov. Such requests should include a detailed description of the accommodations needed and contact information if more information is needed. Please provide advance notice of accommodation needs.

Copies of the documents mentioned in this release are available from the FTC’s Web site at http://www.ftc.gov and from the FTC’s Consumer Response Center, Room 130, 600 Pennsylvania Avenue, N.W., Washington, DC 20580. Call toll-free: 1-877-FTC-HELP.

Update: 4/6/2009 – According to Todd Bavol from Integrity Career Transitions this was the case of a volunteer who was posting to bring awareness to the event who was not aware of common posting etiquette – i.e. posting something RELEVANT to the discussion of the blog.

I'll give them the benefit of the doubt on that. You can register for the Deleware Job Hunters Group event at this site:

www.IntegrityCareerTransitions.com

As usual, I've maintained the old post for historical purposes:

I noticed The Delaware Job Hunters Education and Networking Event when I saw a random blog comment from Integrity Career Transitions in the spam section of the WorkAtHomeTruth blog.

Sure enough, The Delaware Job Hunters Education and Networking Event had posted a completely random, unrelated comment at the end of this article about Zero-Fee Home Business Trials. I decided to approve the comment because it's a great example of how NOT to post in blog discussions and how to get labeled a blog spammer instead of a value-added contributor to a blog discussion.

So let's see what's wrong with the post made by The Delaware Job Hunters Education and Networking Event:

It is not directly related to the top of the article. Although there may be some overlap in the audience for their site and the topic of the article that's not enough to prevent it from being considered blog spam. Any comments in a blog discussion must be very tightly related to the topic of the blog post.

It promotes the IntegrityCareerTransitions.com website within the blog post. While posting a link within a blog post isn't defacto blog spamming, because the post by The Delaware Job Hunters Education and Networking Event is so off-topic, the fact that they also posted a link to another website makes it even more of an example of off-topic spam.

It doesn't reference the article posted on the page at all. In fact a post like that could easily be made by automated blog-spamming software.

I'll be examing The Delaware Job Hunters Education and Networking Event in more detail, but one question you should ask yourself is whether you want to work with a company that claims to be able to help you in your job search if they don't even know the basic rules of Net Etiquette.

Also, I'll show you the CORRECT means by which other business have approached WorkAtHomeTruth to request we mention their websites or events.

I feel a little bad that I removed the Delaware Job Hunters Group phone number from their blog spam comment, so to be fair I've generated all possible permutations of their 7 digit phone number that follows their 302 area code. So now you at least have a fighting chance of getting their correct phone number via the following easy to follow flash slideshow:

Note: It's not clear whether IntegrityCareerTransitions had anything to do with this blog-spamming incident or if it was merely a solo act of The Delaware Job Hunters Education and Networking Event.

Digital rights management (DRM) refers to technologies typically used by hardware manufacturers, publishers, and copyright holders to attempt to control how consumers access and use media and entertainment content. Among other issues, the workshop will address the need to improve disclosures to consumers about DRM limitations.
